Truck driver wins lawsuit after wrongful firing for safety refusal

A truck driver has been awarded almost $30,000 after being fired for refusing to haul an oversize load without the necessary escort.

Details: In December 2023, the driver was at a Tennessee rest stop when he noticed the next part of his route needed an escort. The driver informed his company, Truestart Transport, but was told to ignore the requirement.

  • The dispatcher told the driver to either complete the route without an escort or be fired.
  • The driver refused, resulting in him being stranded at the rest stop and having to travel home to Texas out of his own pocket.

OSHA investigated and found the company's actions illegal. The driver was awarded $9,698 in back wages and interest, $10,000 in punitive damages, and $10,000 in compensatory damages, according to an OSHA press release.

Truestart Transport did not respond to OSHA during the investigation process, leading to the order for compensation to the driver.

Thankfully, the driver will now receive just compensation for his ordeal, which includes back pay and damages.
